KNOXVILLE, Tenn. (Story courtesy of WVLT) – The driver convicted and sentenced to 27 years behind bars for killing two people in a wrong-way Pellissippi Parkway crash wants a new trial.
Eduardo Deavila has filed a motion for a repeat trial, something that generally means he thinks his original trial was in error. A motion for a new trial, per Cornell, asks the court to invalidate a past judgement and reexamine what happened.
“The grounds for granting a motion for a new trial include a significant error of law, verdict going against the weight of evidence, irregularity in the court proceeding, jury misconduct, newly discovered material evidence, and improper damages,” the law school’s website says.
Deavila was sentenced in August of last year after prosecutors argued he was driving in the wrong direction on Pellissippi Parkway with a blood alcohol content of .212, more than twice the legal limit.
